Kwabena Adu Boahene
An Accra High Court on Friday, October 17, 2025, dismissed an application by the defence team of Kwabena Adu Boahene to stay ongoing trial proceedings pending the outcome of an appeal. The defence had sought to suspend the criminal trial while appealing a previous High Court decision that denied them access to certain disclosure documents. They argued that without those documents, they could not receive a fair trial.
However, the court rejected their request, ruling that the defence had failed to show exceptional circumstances warranting a suspension. As a result, the trial will continue concurrently with the appeal.
Opposition
On behalf of the state, the Deputy Attorney-General, Dr Justice Srem-Sai, opposed the stay application, maintaining that the defence had not demonstrated that the requested documents were relevant, or even in the possession of the state, echoing arguments made in the earlier refusal to grant additional disclosure.
Withdrawn charges
In a related development, the Attorney-General, Dr Dominic Ayine, withdrew charges against co-accused Mildred Donkor under Section 59 of Act 30 so she could be called to testify. In the notice filed on October 15, Donkor is expected to testify on her involvement in certain transactions and her relationship with Adu Boahene and other parties.
Kwabena Adu Boahene and three others face several charges, including stealing, money laundering (in relation to GH¢49.1 million), willfully causing financial loss to the state, and abuse of public office.
